Case Study A mother refuses to allow a doctor to provide a legally required immunization for her child. The outcome of this case depends on whether the state can display a compelling public interest in preventing the spread of communicable disease. Typically, the decision of the legislature in making laws regarding required immunizations have been upheld. In some states and in some cases, objections based on religious or philosophical grounds have been allowed. Can the child’s mother prevail if she objects based on the pain it will cause the child?
